Terms & Conditions

These terms apply when you register your interest on this website. They are written to be read, not to hide anything. If something here isn't clear, email us and we'll explain it.
1. Who we are
BUFF is a brand of The Spoon Lab Limited, a company registered in Hong Kong. You can reach us at WhatsApp +852 9502 8023.
2. Registering interest is not a purchase
Registering your interest does not create a contract of sale, and does not reserve stock for you. No payment is taken. No card details are collected. You are not obliged to buy anything, ever.
Registering your interest does two things:
- It records that you're interested, and the quantity you're considering.
- It holds the founding price shown to you at the time you registered.
3. What happens next
When our first production run is confirmed, we will email you with the confirmed delivery date, the final price, and a payment link. The price will never be higher than the price you were shown.
A contract of sale is formed only when you complete that payment and we confirm your order in writing. Until that moment, you owe us nothing.
If you don't respond to that email, nothing happens. You will not be charged, and your registration simply lapses.
4. Your price hold
The founding price is held for you personally, for the quantity you registered, and for the first production run only. If you later increase your quantity, the additional cups may be at the price current at that time.
We may close the founding-price offer at any time. Anyone who has already registered keeps the price they were shown.
5. If we're delayed, or can't deliver at all
We are a new business bringing a new product to market, and production timelines can move. We would rather tell you the truth late than a comfortable guess early.
If our timeline changes, we will email you with a revised date. If we find we cannot produce or deliver at all, we will tell you that too, promptly.
Because no money changes hands at this stage, a delay or cancellation on our side costs you nothing.
6. Withdrawing your interest
Cancel at any time, for any reason, by emailing WhatsApp +852 9502 8023. No reason is required and there is nothing to refund. We'll confirm by reply.
7. Accuracy of what you tell us
Please give us a real email address and WhatsApp number — they're the only ways we have to reach you. We're not able to honour a price hold we can't contact you about.
8. Referral reward
No purchase necessary. Taking part is free, and you never have to buy anything to qualify.
When you register your interest you receive a referral code. If another person registers using your code, both of you qualify for a piece of BUFF merchandise.
This is limited to the first 50 people — that is 25 referrer-and-friend pairs — counted in the order registrations are received. Once 50 people have qualified, the offer closes.
We will contact qualifying people about their merchandise when we launch. Merchandise is not exchangeable for cash or product, and cannot be transferred. If a specific item becomes unavailable we may substitute one of similar value.
We may void a qualification we reasonably believe to be fraudulent, automated, or created using duplicate or fake identities. Where we do so, we will tell the person why.
9. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Hong Kong law.
Subject to that:
- our total liability to you in connection with any order is limited to the amount you actually paid for that order;
- we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss of data;
- we are not liable for loss arising from your failure to store the product correctly after delivery, or from your not being available to receive a delivery.
10. Product information
We take care to describe BUFF accurately. Nutritional values are typical values and may vary slightly between batches. Product photographs are illustrative. If you have an allergy or a specific dietary requirement, please check the ingredient list on the pack and contact us if anything is unclear.
11. Pricing and description errors
If we discover an error in the price or description after you have registered or ordered, we will contact you as soon as we can and give you the choice of confirming at the corrected price or cancelling for a full refund. We are not obliged to supply at an incorrect price.
12. Our right to refuse or cancel
We may decline or cancel any interest registration or order at our discretion, including where:
- we suspect fraud, or abuse of our referral scheme;
- we are unable to deliver to your address;
- the order appears to be for resale without our agreement;
- production or supply constraints prevent us from fulfilling it.
If we cancel an order you have already paid for, we will refund you in full. That refund is your sole remedy in those circumstances.
13. Events outside our control
We are not liable for any delay or failure to perform caused by events beyond our reasonable control — including extreme weather, typhoon or black rainstorm warnings, epidemic or public health measures, failure of our manufacturer or delivery partner, equipment or power failure, or government action.
If such an event occurs, we will tell you, and will either extend the timeline or cancel and refund you.
14. Intellectual property
All content on this website — including the BUFF name, logo, text, photographs, recipes and design — belongs to The Spoon Lab Limited or is used under licence. You may not copy, reproduce, distribute or use it commercially without our written permission.
15. Website availability
This website is provided on an "as is" basis. We do not guarantee that it will always be available, uninterrupted or error-free, and we may change, suspend or withdraw it at any time without notice.
16. General
- Assignment. We may transfer our rights and obligations under these terms to another business. You may not transfer yours without our written consent.
- Third parties. No one other than you and us has any right to enforce these terms. The Contracts (Rights of Third Parties) Ordinance (Cap. 623) does not apply.
- Severability. If any part of these terms is found to be unenforceable, the remainder continues to apply.
- Waiver. If we do not enforce a right straight away, that does not mean we have given it up.
- Entire agreement. These terms, together with our Privacy Policy and Refund & Delivery Policy, form the whole agreement between us.
17. Changes to these terms
We may update these terms as our launch plans firm up. If a change materially affects you, we'll email everyone on the interest list.
18. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the Hong Kong courts have exclusive jurisdiction.
19. Language
These terms are provided in English and Traditional Chinese. If there is any inconsistency between the two versions, the English version prevails.

2. 登記興趣並不等於購買
登記興趣並不會構成買賣合約，亦不會為你保留貨品。我們不會收取任何款項，不會收集信用卡資料，你亦沒有任何購買義務。
登記興趣只做兩件事：
- 記錄你有興趣，以及你考慮的數量。
- 為你保留登記當時所顯示的創始價。
3. 接下來會發生甚麼
當首次生產確認後，我們會電郵你確實的送貨日期、最終價格及付款連結。價格永遠不會高於你當時看到的價格。
只有當你完成付款、而我們以書面確認你的訂單後，買賣合約才會成立。在此之前，你不欠我們任何款項。
如果你沒有回覆該電郵，不會有任何後果。我們不會扣款，你的登記只會自動失效。
4. 價格保留
創始價只為你本人保留，數量以你登記的為準，並只適用於首次生產。若你其後增加數量，額外的杯數可能按當時的價格計算。
我們可隨時結束創始價優惠。已登記的人士，仍可享有當時所顯示的價格。
5. 如果延誤，或最終未能推出
我們是一間新公司，推出一款新產品，生產時間表有機會變動。與其早早給你一個好聽的猜測，我們寧願遲一點告訴你事實。
若時間表有變，我們會電郵你更新後的日期。若我們發現最終無法生產或送貨，我們亦會盡快如實告知。
由於此階段不涉及任何金錢，我方的延誤或取消不會令你有任何損失。
6. 撤回登記
你可以隨時、以任何理由取消，只需電郵 WhatsApp +852 9502 8023。毋須提供理由，亦沒有任何款項需要退還。我們會回覆確認。
7. 資料準確性
請提供有效的電郵地址及 WhatsApp 號碼 — 這是我們聯絡你的唯一方法。若無法聯絡你，我們將無法為你保留價格。
8. 推薦獎賞
毋須購買。參加完全免費，你不需要購買任何產品即可符合資格。
你登記興趣後會獲得一個推薦碼。若有其他人使用你的推薦碼登記，你們雙方均符合資格獲得一件 BUFF 精品。
名額只限首 50 位 — 即 25 對推薦人與朋友 — 按登記次序計算。當 50 個名額用完，此優惠即告結束。
我們會在正式推出時就精品與符合資格的人士聯絡。精品不可兌換現金或產品，亦不可轉讓。若某項物品無法提供，我們可以相若價值的物品代替。
如我們合理相信某項資格涉及欺詐、自動程式，或使用重複或虛假身分取得，我們可將其作廢，並會向對方說明原因。
9. 責任限制
本條款並不排除或限制我們就以下事項的責任：因我們疏忽而導致的死亡或人身傷害、欺詐或欺詐性失實陳述，以及任何根據香港法律不得合法排除或限制的責任。
在上述前提下：
- 我們就任何訂單對你承擔的總責任，以你就該訂單實際支付的金額為上限；
- 我們不就間接或相應而生的損失、利潤損失、機會損失或資料損失承擔責任；
- 我們不就以下情況所引致的損失承擔責任：你在收貨後未有妥善存放產品，或你未能在送貨時在場接收。
10. 產品資料
我們力求準確描述 BUFF。營養數值為典型數值，各批次之間可能略有差異。產品相片僅供參考。如你有過敏或特定飲食需要，請查閱包裝上的成分表；如有任何不清楚之處，請與我們聯絡。
11. 價格及描述錯誤
若我們在你登記或落單後發現價格或描述有誤，我們會盡快與你聯絡，讓你選擇按更正後的價格確認，或取消並獲全額退款。我們沒有義務按錯誤價格供貨。
12. 我們拒絕或取消的權利
我們可自行酌情拒絕或取消任何興趣登記或訂單，包括在以下情況：
- 我們懷疑涉及欺詐，或濫用我們的推薦計劃；
- 我們無法送貨至你的地址；
- 訂單看似用於未經我們同意的轉售；
- 生產或供應限制令我們無法履行。
若我們取消你已付款的訂單，我們會全額退款。在該等情況下，該退款為你的唯一補救。
13. 非我們所能控制的事件
我們不就因超出我們合理控制範圍的事件所引致的延誤或未能履行承擔責任 — 包括極端天氣、颱風或黑色暴雨警告、疫情或公共衞生措施、生產商或送貨夥伴的失誤、設備或電力故障，或政府行動。
若發生此類事件，我們會通知你，並會延長時間表或取消訂單並退款。
14. 知識產權
本網站所有內容 — 包括 BUFF 名稱、標誌、文字、相片、配方及設計 — 均屬 The Spoon Lab Limited 所有或經授權使用。未經我們書面許可，你不得複製、翻印、分發或作商業用途。
15. 網站可用性
本網站按「現狀」提供。我們不保證網站會一直可用、不會中斷或完全沒有錯誤，並可隨時在不另行通知的情況下更改、暫停或撤下網站。
16. 一般條款
- 轉讓。我們可將本條款下的權利及義務轉讓予其他業務實體。未經我們書面同意，你不得轉讓你的權利及義務。
- 第三者。除你與我們之外，任何人均無權執行本條款。《合約（第三者權利）條例》（第 623 章）不適用。
- 可分割性。若本條款任何部分被裁定為不可執行，其餘部分仍然有效。
- 不放棄。若我們沒有即時行使某項權利，並不代表我們已放棄該權利。
- 完整協議。本條款連同我們的私隱政策及退款及送貨政策，構成你我之間的完整協議。
17. 條款修改
隨着推出計劃逐步落實，我們可能會更新本條款。若修改對你有重大影響，我們會電郵通知興趣名單上的所有人。
18. 適用法律
本條款受香港特別行政區法律管轄，並以香港法院為專屬管轄法院。
19. 語言
本條款提供英文及繁體中文版本。如兩個版本有任何不一致之處，概以英文版本為準。
